Many legal experts advise clients to file complaints in Delaware because they are likely to get a “fair shake” from knowledgeable judges and juries. Delaware’s federal court saw a 64 percent increase in patent filings from 2000 to 2007, one of the largest jumps nationwide. The statistics show that plaintiffs are more likely to receive a favorable ruling; Patent owners win here 40.8 percent of the time, one of the highest rates among federal courts.
