Delaware’s reputation for patent lawsuits is growing
Many legal experts advise clients to file complaints in Delaware because they are likely to get a “fair shake” from knowledgeable judges and juries. Additionally, summary judgments are less common in Delaware than in other venues, which can benefit patent owners because of the money it takes to defend against an infringement claim.

Delaware’s federal court saw a 64 percent increase in patent filings from 2000 to 2007, one of the largest jumps nationwide. The statistics show that plaintiffs are more likely to receive a favorable ruling; Patent owners win here 40.8 percent of the time, one of the highest rates among federal courts.
